Introduction
As a result of an
EEC directive "the use of work equipment directive"
a significant change was brought about in our legislation effecting
machinery and other work equipment. The majority of those changes
were to be contained in the provision and use of work equipment
regulations 1992 (PUWER 92).
In 1995, a further
directive was agreed, the amending directive to the use of work
equipment directive which lead to the implementation of a further
set of regulations being the provision and use of work equipment
regulations 1998 (PUWER 98). These new regulations replaced the
earlier version in their entirety. In effect, they added new
information to what which was already there rather than providing
a radical change throughout.
Puwer 98 was brought
into effect in stages as follows :
- The regulations
came into force on 5th December 1998
- The regulations
in part three dealing with mobile work equipment, i.e. regulations
25-30 will not apply to work equipment provided for use in the
undertaking or establishment before 5th December 1998 until 5th
December 2002.
