Provision and Use of Work Equipment Regulations 1998 (PUWER 98)

Regulations made under the factories act included :

  • Power presses regulation 1965
  • Power presses (amendment) regulations 1972
  • Abrasive wheels regulations 1970
  • Woodworking machines regulations 1974
  • Construction (lifting operations) regulations 1961
  • Construction (general provisions) regulations 1961

The in these regulations was then supplemented in 1975 by the requirements of section 2.2(a) of the health and safety at work etc. Act 1974 that called for :

" the provision and maintenance of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health" and

" plant is defined to include…….any machinery, equipment or appliance".

At the same time, section 6 of the act imposed duties on any person who designs, manufacturers, imports or supplies any article for use at work, an article being :

  • Any plant designed for use or operation (whether exclusively or not) by persons at work , and
  • Any articles designed for use as a component in any such plant.
